Engaging policy debates are slated for this year’s Business Session on topics of 1) whether willfulness is required for any award of an accounting for a defendant’s profits under the Lanham Act; and 2) disclaiming a component of a mark sought to be registered. An Open Forum following the Business Session will present a discussion on two topics: 1) deferred examination of patent applications; and 2) whether embodiments lasting only a transitory duration are “copies” under the Copyright Act.
